JUDGMENT:

This Criminal Appeal, under Section 377 (2) of the Code of Criminal Procedure, 1973, (‘Cr.P.C.’, for brevity) is filed by the State to enhance the sentence imposed against the accused by virtue of judgment, dated 20.06.2008, made in S.C.No.75 of 2007 on the file of the Special Sessions Judge for SC/STs (POA) Act, Nalgonda, whereunder and whereby, respondents/accused were found guilty of the offences punishable under Sections 448 and 323 I.P.C. and sentenced to pay fine of Rs.1,000/- each for each of the offences and in default, to undergo simple imprisonment for a period of three months each. However, all the accused were acquitted for the offence punishable under Section 3(1)(x) of SC/STs(POA) Act, 1989 (‘the Act’, for brevity)

2. The brief facts that are necessary for the disposal of the prosecution case may be stated as follows.

P.W.1 was working as Mandal Revenue Officer of Pedda Adiseralapally Mandal. He was residing in a rented house. His brother-in-law was also staying with him for the last six months, assisting him in the house-hold and office work. On 26.05.2005 at about 07:00 P.M., while P.W.1 along with Mandal Revenue Inspector were discussing the annual

revenue accounts and other revenue matters with Senior Assistant, the accused, all of a sudden, intruded into the house of P.W.1 in a drunken condition by opening the door and then bolted it from inside and abused P.W.1 by name of his caste in filthy language alleging that brother-in-law of P.W.1 wrote a love-letter to a girl of their relation. The accused beat him with chappals and hands, and thereafter, left the house of P.W.1. Thereafter, P.W.1 gave report to the police and the said report was registered as Cr.No.47 of 2005. P.W.9, who was appointed as Investigating Officer, took up investigation and arrested the accused and filed the charge sheet against them.

3. When the charges under Sections 448, 323, 353 and 506 read with 34 I.P.C. and Section 3(1)(x) of the Act were framed, read over and explained to the accused in Telugu, they denied the offence, pleaded not guilty and claimed to be tried.

4. To substantiate its case, the prosecution examined P.Ws.1 to 8 and got marked Exs.P.1 to P.5.

5. After closure of the prosecution evidence, the accused were examined under Section 228 (1)(b) Cr.P.C. with reference to the incriminating circumstances appearing against them in the evidence of prosecution witnesses. They denied the same.

6. The trial Court, after elaborate consideration of the evidence, found the accused guilty for the offences punishable under Sections 448, 323, 353 and 506 read with 34 I.P.C. and Section 3(1)(x) of the Act and accordingly

convicted and sentenced them as above.

Now the point for determination is whether the prosecution proved its case beyond all reasonable doubt against the accused of the offence punishable under Sections 448, 323, 353 and 506 I.P.C. and Section 3(1)(x) of the Act, and whether the judgment of the trial Court is correct, legal and proper?

The learned counsel representing the learned Public Prosecutor contended that trial Court was very lenient in awarding punishment to the accused, which ought to have awarded maximum punishment to the accused. She also contends that the trial Court had not considered the evidence of prosecution witness in a correct perspective and hence, she prays to enhance the sentence imposed by the trial Court.

9. There cannot be any dispute that this appeal is with regard to enhancement of sentence. The evidence of the prosecution should be in proportion with the severity of the crime committed by the accused. On the ground that no previous cases were filed against the accused and as this was the first offence committed by them, the trial Court might have taken a lenient view in awarding the said conviction and sentence. It is stated that A-1 is having an old aged mother and also his wife is depending on him. A-2 stated that he is the only son of his parents and he is having a sister whose marriage is yet to be performed. A-3 stated that he was having two sisters and he also should perform their marriage, besides having two children. The allegation against the accused is that they have trespassed into the house of the

complainant and beat the complainant with chappal. Though it is alleged that all the accused abused P.W.1 in the name of his caste, it is not correct. P.W.1 has not sustained any grievous injuries. As a matter of fact, he received simple injuries. He was not even referred to any doctor for medical examination of injuries. There were no disputes between the accused and P.W.1. The intention of the accused is to take revenge against the brother-in-law of the accused, who allegedly written a love-letter to a girl of their relation, which caused annoyance to the accused. Therefore, there are no substantive and compelling reasons to interfere with the judgment of the trial Court. The said order of the trial Court does not suffer from any infirmities so as to call for interference by this Court. Hence, the Criminal Appeal is devoid of merit and is liable to be dismissed.

10. Accordingly, the Criminal Appeal is dismissed at the stage of admission, confirming judgment, dated 20.06.2008, made in S.C.No.75 of 2007 on the file of the Special Sessions Judge for SC/STs (POA) Act, Nalgonda.
