ORDER:

This contempt case is filed complaining willful disobedience on the part of the respondents in implementing the orders of the Court in W.P.M.P.No.25845 of 2009 in W.P.No.19820 of 2009 dated 17.09.2009, wherein the respondents were directed not to dispossess the petitioners from the property admeasuring Acs.14.00 in survey No.833, Acs.14.00 in survey No.834 and Acs.10.01 guntas in survey No.835 situated at Siripur Sivar Village, Nizamabad Mandal, Nizamabad District, without following due process of law.

The respondents filed a counter affidavit stating that the petitioners have purchased government assigned land in survey No.834 (part) in violation of the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfer) Act, 1977 and amended Act, 2007 and the Rules framed thereunder. Therefore, notices in Form I and II were issued to them as prescribed under law. However, the petitioners refused to receive the notices and thus the notices were pasted on the conspicuous place of the land. Further the petitioners have not filed any objections before the fourth respondent or respondent Nos.2 and 3. The land in question was resumed by the Government vide proceedings No.A5/51116/2007 dated 04.09.2008 and possession was taken on 06.09.2008. Further possession of the land was handed over to the fifth respondent on 20.02.2009. The petitioners kept quiet from 06.09.2008 to September, 2009 and filed the writ petition with misconceived facts claiming that they are in possession of the property and the respondents dispossessed them.

Under the facts and circumstances of the case, particularly, in view of the details mentioned in the counter affidavit, it cannot be said that the respondents have dispossessed the petitioners after the orders passed by this Court on 17.09.2009.

The Contempt Case is devoid of any merit and accordingly the same is closed.
