This writ petition, filed under Article 226 of the Constitution of India, challenges the draft declaration vide ORR No.59, No.D/ORR/119, dated 20.04.2006, issued by the Project Director and Special Collector, Outer Ring Road and the Special Deputy Collector (L.A), Unit No.VII, Outer Ring Road, Tarnaka, Hyderabad, issued under Section 6 of the Land Acquisition Act pertaining to the acquisition of the land of the petitioners in Sy.No.298 admeasuring Ac.1-36 guntas situated at Puppalaguda village, Rahendranagar Mandal, Ranga Reddy District for outer ring road purpose.

When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner as well the learned Standing Counsel appearing for the respondents 2 to 4 that the issue in the rpesent writ petition is covered by the earlier orders of this Court in W.P.No.6759/2008 dated 01.04.2008 and a copy of the said order is placed on record.

Following the above referred judgment and for the reasons recorded therein, this Writ Petition is allowed setting aside the draft declaration vide ORR No.59, No.D/ORR/119, dated 20.04.2006, issued by the Project Director and Special Collector, Outer Ring Road and the Special Deputy Collector (L.A), Unit No.VII, Outer Ring Road, Tarnaka, Hyderabad, under Section 6 of the Land Acquisition Act. Consequently, pending miscellaneous petition, if any, shall stand dismissed. No order as to costs.
