Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in initiating summary eviction proceedings under Land Eviction Act 1905 against the petitioners in respect of premises No.10-5-1/1 Admeasuring 438 Sq.yards (366.11 sq mtrs) situated at Masab Tank Hyderabad as arbitrary and without jurisdiction and consequently pleased to set aside the eviction order passed by the respondent No.3 in file No.Ms/861/04 dt 15-03-2004 confirmed by the respondent No.2 in case No.B/1036/04 dt 09-09-2003 as no nest in the eye of last without jurisdiction.
The petition coming on for hearing, upon perusing the petition and the affidavit filed in support there of and the High Court order dated 31/12/2008 and made herein and upon hearing the arguments of Sri VIJAY KUMAR HEROOR, Advocate for the Petitioners and GP for Revenue for the Respondents and the Court made the following

At the request of th learned Government Pleader, Post on 06.02.2009. The interim order passed by this court on 31.12.2008 is extended till then.
