ORDER:

T h e Mandal Revenue Officer/Tahsildar, Shamshabad, 2^nd respondent herein made certain entries in the revenue records as regards the land in Survey No.7 o f Satamrai Village, Shamshabad Mandal, on 31.03.1995. The petitioner appears to have filed an application before the 2^nd respondent, for correction of the entries. The 2^nd respondent passed an order on 21.12.2007 rejecting the request of the petitioner. Thereupon, the petitioner filed a revision under Section 9 of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 (for short “the Act”) together with an application for stay before the District Collector, Ranga Reddy, 1^st respondent herein. His grievance is that so far, no orders have been passed either in the revision or in the stay petition.

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

Though Section 5 of the Act provides for a remedy of appeal, the petitioner has chosen to avail the remedy of

revision under Section 9 of the Act. However, he presented the revision before the District Collector, though the powers of revision are conferred upon the Joint Collector. In that view of the matter, no action can be expected from the 1^st respondent. Even now, the petitioner can pursue the proper remedy.

Therefore, the Writ Petition is disposed of, leaving it open to the petitioner to present a revision before the Joint Collector. As and when the revision is presented, it shall be dealt with in accordance with law. There shall be no order as to costs.
