ORDER:-
This Court issued Rule Nisi on 23.10.2009.
2. The writ petition is filed for a writ of mandamus to declare the action of respondent No.1 for non constitution of Dharmika Parishad in view of the amendment made to Section 51 by Act No.33/2007 empowering the Dharmika Parishad to take action against any erring Mathadhipath, in pursuance of the order in O.A.No.6/2007 dated 12.11.2008 passed by respondent No.2 in respect of Sri Ram Chandra Devasthanam Sangam Mutt situated
at Babughat Sangam, Langarhouse, Golconda Road, Hyderabad, as illegal, arbitrary and against the principle of natural justice and pass such other suitable orders.
3. It is brought to the notice of the Court that the Dharmika Parishad has been constituted.
4. The grievance of the petitioner is that the matter pending before respondent No.2 is not being disposed of. The Dharmika Parishad is constituted to take further steps for the disposal of the said matter. Liberty is given to the petitioner to take appropriate steps in this regard. In as much as Dharmika Parishad has already been constituted, no further orders need be passed in this writ petition.
5. The writ petition is, accordingly, closed with an observation that this would not cause any prejudice to the contentions or the rights of respondent No.5. There shall be no order as to costs.
