Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an appropriate writ, order or direction preferably one in the nature of writ of mandamus declaring the impugned G.O.Ms.No.363, Municipal Administration & Urban Development Department, dated 29th April, 2005 issued by the 1st respondent as illegal, arbitrary, contrary to provisions of A.P.Transition Area & Small Urban Areas (Fixation of Criteria) Rules, 1995 and the A.P.Municipalities (Gradation of Municipal Councils & Nagara Panchayats) Rules, 1995 as well as A.P.Panchayat Raj Act, 1994 and consequently set aside the same to enable the existing Rayachoty Gram Panchayat to function as usual; and pass such other or further orders as are deemed fit and proper in the circumstances of the case.

Petitioner herein is the Sarpanch of Rayachoty Gram Panchayat, who was elected to the office in the year 2002. This writ petition is filed aggrieved by the action of the respondents in not allowing her to exercise cheque drawing power as Sarpanch of the Gram Panchayat and run the local body by distributing the benefits under various schemes.
Since the term of the petitioner as Sarpanch expired long back, nothing survives for adjudication on merits at this point of time. Accordingly, the writ petition is dismissed as infructuous. No costs.
