This writ appeal is directed against the order of the learned single Judge made in Writ Petition No. 20994 of 2008, dated 6.11.2007, whereby the learned single Judge allowed the writ petition filed by the writ petitiner/1^st respondent herein.

The 1^st respondent-writ petitioner filed the aforementioned writ petition before the learned single Judge seeking to set aside the order of the Labour Court, Anantapur, made in M.P. No.410 of 2002, dated 5.3.2004 . The learned single Judge, by the order impugned in this writ appeal, allowed the writ petition only on the sole ground of non-appearance of the respondents. Challenging the same, the appellants, who are respondents 1 and 10 to 13 have filed the present appeal.,

Heard the learned counsel for the appellants and the learned Government Pleader for Labour and perused the order of the learned single Judge.

Admittedly, when the respondents failed to appear before the learned single Judge despite the matter having been adjourned for more than five occasions, the learned single Judge passed the impugned order allowing the writ petition by setting aside the order dated 5.3.2004 of the Labour Court.

As the learned single Judge has given sufficient opportunity to the appellants before passing the impugned order, we do not find any reason to interfere with the same.

At this stage, learned counsel for the appellants requested the Bench that liberty may be granted to him to move appropriate application before the learned single judge.

While reserving such liberty, the writ appeal is disposed of. No costs.
