Admittedly, the Sessions Case was numbered in 2004. For one reason or the other the Non Bailable Warrants (N.BWs) have been pending against the petitioners. It appears that the petitioners filed a petition to recall NBWs under Section 70 (2) of Cr.P.C. on 23-07-2009. However, the said petition was dismissed with an endorsement that the petitioners absent. Hence the petition rejected. Challenging the same, this Revision Petition has been filed.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

The learned counsel for the petitioners submitted that the petitioners are on bail and after filing charge sheet they have not received any summons from the Court and that they have no knowledge about pending of NBWs issued against them. Since the lower Court records are not here, it is not possible to verify the contentions raised by the learned counsel for the petitioners. However, the Revision can be disposed of with the following consent order as agreed by the learned counsel for the petitioners.

The petitioners are directed to surrender before the Special Judge for the trial of cases under the provisions of Scheduled Castes and Scheduled Tribes (Prevention Of Atrocities) Act, 1980,

Nellore-cum-V Additional District Judge, Nellore, on or before 30^th of October, 2009. On such surrender, they shall be enlarged on bail on each of their executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Special Judge for the trial of cases under the provisions of Scheduled Castes and Scheduled Tribes (Prevention Of Atrocities) Act, 1980, Nellore-cum-V Additional District Judge, Nellore. The petitioners shall regularly attend the Court without fail.

Accordingly, the Criminal Revision Petition is disposed of.
