Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ order or direction particularly in the nature of Writ of Certiorari by calling for the records of the Proceedings in ROC.No.C3/15702/97, dated 17.3.2000 on the file of the Collector and District Magistrate, Chittoor and quash the same is being illegal arbitrary and without any authority or Jurisdiction apart from being violative of principles of natural justice and due process of law and rules of procedure prescribed in A.P. (ST, SC & BC) issue of community, Nativity and date of Birth certificate Rules 1997 and violative of Articles 14 & 21 of the Constitution of India;
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI KOWTURU VINAYA KUMAR Advocate for the Petitioner, and of Govt. Pleader for Social Welfare for respondents 1, 2 and 4, and of Sri G. Vidya Sagar, Advocate for the respondent No.3, the Court made the following:
ORDER:
“Post on 26-11-2012 under the caption ‘for appearance’ on which date the Principal Secretary, Tribal Welfare shall file an affidavit explaining reasons for the inordinate delay in complying with the orders of this Court, and show cause why action not be initiated against him under the contempt of Courts Act.
The Principal Secretary, Tribal Welfare is present in Court today. He shall again be present on 26-11-2012.”
