Uppala Sravan Vs The District Collecor, Krishna District

This writ petition is filed for issuance of writ of mandamus declaring the action of the respondents herein in not granting stay of dispossession pending disposal of the appeal, as illegal, arbitrary and violative of the principles of natural justice and consequently to direct the respondents herein not to initiate any action to dispossess the petitioner herein from the land admeasuring Acs.2.00 cents in R.S.No.130/1 with fish tank therein situated in Polukonda Village of Nandivada Mandal, Krishna District, pending disposal of R.C.D.No.1283 of 2007 before the respondent No.2 and to pass such other suitable orders.

It is brought to the notice of this Court that the appeal is pending before the second respondent and in the meanwhile if the interest of the petitioner is not protected, the petitioner would be prejudiced.

In the light of the same, let the second respondent dispose of the appeal within a period of six weeks from the date of receipt of a copy of this order. Till then, status quo, obtaining as on today, shall be maintained.

The writ petition is accordingly disposed of. There shall be no order as to costs.
