Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a Writ Direction or Order more particualrly one in the nature of Writ of Mandamus, declaring the action of the respondents in not issuing the concessional bus passes to the students of the Petitioner's College, is illegal, arbitrary, and unconstitutional and consequently direct the respondents to issue the bus passes to the students of the petitioner's College's , and to pass such other order

The writ petition is filed seeking a writ of Mandamus declaring the action of respondents in not granting concessional bus passes to the students of petitionercolleges as arbitrary and illegal, and consequently direct respondents to grant the same.

Heard learned counsel for petitioners and learned Government Pleader for Education.

A similar batch of writ petitions in W.P.No.28965 of 1997 and batch were disposed of by this Court on 15.03.1999 with the following directions. The writ petitions are disposed of with a direction that the petitioners’ students and similarly situate students shall be extended the benefit of scholarships for SC/STs and BCs and they shall also be issued concessional bus and railway passes in accordance with their respective rules and regulations without reference to the stipulations made by the Intermediate Board in respect of these two benefits while granting recognition. If any applications are already pending before the authorities for extension of these benefits, the same shall be considered in accordance with rules and regulations.

In view of this, the writ petition is disposed of in terms of directions granted in W.P.No.28965 of 1997 and batch with regard to grant of bus pass only. However, if the students of petitioner-colleges have completed their course, they shall not be entitled for any concessional bus passes.

The writ petition is accordingly disposed of. No costs.
