Writ Petition No. 14351 of 1997

Order:

Sri P.B. Vijay Kumar, learned counsel for the petitioner, submits that the petitioner does not desire to continue in the service of the respondents and that the dispute revolves only around non-payment of his terminal benefits. Learned counsel would submit that it would suffice if this Court while disposing of the writ petition leaves it open to the petitioner to submit a representation to the respondents for payment of his terminal benefits and a direction is given to the respondents to pass orders on his representation within a specified time frame. Learned counsel would further submit that the petitioner no longer desires to challenge the impugned order.

Recording the submission of the learned counsel that he is not pressing for adjudication on the validity or otherwise of the impugned order, the writ petition is disposed of permitting the petitioner to submit a representation to the respondents for payment of his terminal benefits. In case the petitioner submits a representation within four weeks from the date of receipt of a copy of this order, the respondents shall examine the same and pass appropriate orders thereupon in accordance with law within a period of three months from the date of receipt of such representation.

The writ petition is disposed of accordingly. No costs.
