A. Babaiah S/o Subbaiah Vs Government of Andhra Pradesh Consumer Affairs

The petitioner claims to be a licensed dealer under the provisions of AP Schedule Commodities Dealers (Licensing and Distribution) Order 1982. On 21.2.2007 850 bags of Readgram weighing 841.50 Qts. were seized from the AP State Warehousing Corporation Godown, Indiranagar, Kurnool, whereat the petitioner claims to have stored the stock. On 27.2.2007 and again on 5.3.2007 the petitioner submitted representations to the 2^nd respondent for interim release of the seized commodities pending proceedings under Sec.6A of the

Essential Commodities Act 1955. The petitioner's grievance is that his representation has not yet been disposed of by the 2^nd respondent.

In the circumstances, after hearing the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies, the writ petition is disposed of directing the 2^nd respondent to dispose of the petitioner's representations dated 27.2.2007 and 5.3.2007 for interim release of the seized commodities. The 2^nd respondent shall pass an appropriate order on the said representations preferably within 30 days from the date of receipt of a copy of this order. Nothing in this order shall be construed as an expression by this court on the merits of the application of the petitioner for interim release of the seized stock. The application shall be disposed of by the 2^nd respondent on its own merits.
