This writ petition is filed seeking a Mandamus to declare the action of the respondent in not paying the amounts of Gratuity, Group Insurance and LIC to the petitioners, who are legal heirs of late P.D.Sudhakar, who worked as operator in Block II of Indian Drugs & Pharmaceuticals Limited, Balanagar, Hyderabad and died on 19.11.1994, as arbitrary and illegal.

The only grievance of the petitioners is that the husband of the 1^st petitioner P.D.Sudhakar while working as Operator in the respondent company died on 19.11.1994. Thereafter, petitioners have made representations to the respondent company for payment of Gratuity, Group Insurance, LIC amount and for providing

employment to the 1^st petitioner on compassionate grounds. But, the respondent-Company failed to consider the same. Hence, the 1^st petitioner got issued a legal notice to the respondent on 19.8.1996. But, there was no response from the respondent. Hence, the writ petition.

No counter is filed. However, the learned counsel for the respondent states that it is true that the gratuity amounts were not released in favour of the petitioners and in respect of GIS, LIC, the petitioners have to work out their remedies as available under law and the respondent company is not responsible for paying any amounts on that count.

In view of the above, respondent is directed to pay the gratuity amount due against the account of P.D.Sudhakar, who worked as an operator in Block II, Indian Drugs & Pharmaceuticals Limited, Balanagar, Hyderabad, to the petitioners within a period of four weeks, from the date of receipt of a copy of this order.

With the above direction, writ petition is
