This writ petition is filed by the petitioners’ Co.operative Labour Contract Society seeking a writ of Mandamus to declare the action of the respondent in not giving tender schedule to the petitioners-society at free of cost and exemption of EMD in all tenders including works mentioned in the tender notice issued by the first respondent in ROC.No.253/2006/E1 dated 25-09-2007 as illegal and arbitrary.

Learned counsel for the petitioners submits that the petitioners-society has been registered under the Societies Registration Act and has been formed by the persons belonging to SC/ST and Vaddera Community, who are residing within the Narasaraopet Municipality and they are entitled to avail the benefit of the orders of the Government in G.O.Ms.No.581 M.A. dated 0611-1996 for getting sanitation work. He further submits that the

societies are exempted from payment of EMD and they are entitled for tender schedules at free of cost subject to fulfillment of conditions of G.O.Ms.No.52 Transport, Roads & Buildings [B.I-1] Department dated 18-03-2000.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondent to furnish the tender schedules to the petitioners-society at free of cost, exempting the EMD, if they fulfill the required terms and conditions of G.O.Ms.No.52 dated 08-03-2000. No costs.
