ORAL ORDER:
The petitioner is the authorised dealer of the fair price shop of Chilamathur village & Mandal, Ananthapur District. His authorisation was cancelled vide proceedings of the 2nd respondent dated 3.7.2007 after conducting due enquiry. Aggrieved by the same, the petitioner has preferred an Appeal before the 1st respondent along with an application for stay. It is alleged that the 1st respondent failed to consider his Appeal, and no orders have been passed even on his application for stay. Hence, this writ petition.
Having heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents and having regard to the fact that the statutory Appeal is pending before the 1st respondent, without expressing any opinion on merits, the writ petition is disposed of with a direction to the 1st respondent, to dispose of the application for stay field by the petitioner in the Appeal against the order of the 2nd respondent dated 3.7.2007 following due process of law, as expeditiously as possible, preferably within a period of one week from the date of receipt of a copy of this order. No costs.
