ORAL ORDER:
In this writ petition, the petitioners seek issuance of a writ of mandamus declaring the action of the respondents 2 and 3 in not recommending the case of the petitioners for starting its College of Education at Vijayawada, Krishna District and the action of the 1st respondent in not processing and considering the application of the petitioners as illegal and arbitrary, and, consequently direct the first respondent to pass orders on the application of the petitioners.
As per the new regulations framed under the National Council for Teacher Education Act, the petitioners can seek recognition directly by filing application before the first respondent-authority. Thereafter, the Council constituted under the National Council for Teacher Education Act will seek remarks from the respondents 2 and 3, and, even on the respondents 2 and 3 failing to furnish the remarks within the statutory period of 60 days, it is open for the first respondent to consider the application for grant of recognition of College of Education.
In this case, on instructions, it is submitted by Ms.Jhansi, representing the learned Standing Counsel for the National Council for Teacher Education that pursuant to the application submitted by the petitioners, final orders are passed on 14.4.2007 granting conditional recognition to the petitioner-institution. In view of the said orders, while it is open for the petitioners to comply with the conditions stipulated in the orders of recognition, no direction need be issued in this writ petition. The submission of the learned
Standing Counsel for the first respondent is placed on record and the writ petition is closed. No costs.
