ORAL ORDER:
Heard the learned counsel for the petitioners and the learned Assistant Solicitor General of India appearing for the respondents.
Petitioner has filed this writ petition, aggrieved by the proceedings dated 7.11.2003 withdrawing the Assured Career Progression (ACP) benefits granted to the petitioners’ earlier. The withdrawals were on the ground that each of the petitioners’ failed to qualify for the normal promotion norms, in terms of Condition No.6 of the ACP scheme as set out in the office memorandum dated 9.8.1999, and that the internal audit party of the Ministry of Home Affairs had examined the entitlement of the petitioners and had ordered recovery of the additional pay and allowances paid to them under the said Scheme.
Learned counsel for the petitioners states that the petitioners would now like to submit a representation under Rule 56 of the Central Industrial Security Force Rules, 2001 and they do not wish to pursue the writ petition.
Recording the submission and granting them liberty to make representations as sought, the writ petition is dismissed as withdrawn. There shall however be no order as to costs.
