Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an order or direction or writ specially writ of mandamus directing the respondent to consider the application dt. 1-10-2001 of the petitioners and refer the matter u/s. 18 of Land Acquisition Act to the competent Civil Court by declaring the action of respondent in not referring the Award proceedings in so far as the petitioners are concerned to the Civil court as arbitrary, illegal and violative of Art. 14 and 300-A of Constitution of India

The petition coming on for hearing, upon perusing the petition and the affidavit filed herein in support there of and upon hearing the arguments of Sri L. Prabhakar Reddy, Advocate for the Petitioners and the Govt. Pleader for Land Acquisition on behalf of the Respondent, the Court made the following

ORDER:

“This Writ Petition is filed in January, 2005, aggrieved by the respondent’s inaction to refer the petitioners objections to the award, to the Civil Court under Section 18 of the Land Acquisition Act, 1894.

Petitioners asserts that they made a request on 1-10-2001, in respect of an award passed as regards the acquisition of land in S.No. 66 of Chillepally Village, Naredecherla Mandal, Nalgonda District on 1992. Despite passage of 20 months no counter affidavit is forth coming.

In the circumstances, the respondent shall be present on 07-09-2006 along with connected records.

The learned Govt. Pleader for Land Acquisition under takes to inform the respondent.”
