list of candidates for 219 was prepared but however, the very first petitioner who was at serial number 113, who claimed in the OC category, did not come up for selection and so also the case of the second petitioner, who was at serial number 183 in the merit list, were not selected. As they did not figure in the select list at all, it is not open for them to plead for subsequent resultant vacancies, to be filled up only by the candidates of the merit list. Merit list prepared cannot be equated to panel of candidates and the candidates in the select list, for the purpose of recruitment. Further, it is also stated in the counter affidavit that resultant vacancies, which were not filled up from the first list of selected candidates, on account of medical un-fitness or for lack of possessive genuine licenses, were also notified subsequently and all the vacancies were fill up after following due procedure. In that view of the matter I do not find any merit in the Writ Petition to grant a direction as prayed for. 5. Writ Petition is devoid of merit, and accordingly, the same is dismissed. No order as to costs.
