ORDER:
This writ petition is filed seeking a declaration that the alleged action of the first respondent-Deputy Commissioner of Police, Administration, CCS, DD Hyderabad, in not completing the investigation and in not filing the charge-sheet in Cr.No.570/22 on the file of the XXI Metropolitan Magistrate, Hyderabad, as arbitrary and illegal.
In response to the rule nisi ordered, the Assistant Commissioner of Police, Administration, CCS, DD Hyderabad-second respondent, filed counter affidavit on behalf of the respondents stating that after completing the investigation charge-sheet
has already been filed before the court of the XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, on 12-01-2006. The respondents have also explained the reasons for delay in completing the investigation.
In view of what has been stated in the counter affidavit and keeping in view that the charge-sheet has already been filed on 12-01-2006, no further adjudication is necessary on merits.
Accordingly, recording the statement of the respondents in their counter affidavit, the writ petition is disposed of. No order as to costs.
