Amara Prameela Devi, Vs The Joint Collector

This writ petition is filed seeking a mandamus declaring the action of the 1st respondent in not passing any orders on the stay petition filed along with the appeal seeking to set aside the proceedings of the 2nd respondent bearing No.Rc.C/1756/2006 dated 24-10-2006 as arbitrary and illegal; and consequently to direct the 1st respondent to dispose of the appeal in accordance with law.

It appears, the petitioner was the Fair Price Shop Dealer of shop No.37 of Chirala Town and Mandal, Prakasam District. While so, her authorization was suspended pending a detailed enquiry into the irregularities alleged against her. The petitioner, in fact, already invoked the statutory remedy by filing an appeal before the 1st respondent and the same is still pending. It appears, the stay petition filed along with the appeal is also not yet disposed of.

In view of the above, without expressing any opinion on the merits of the case, the 1st respondent-Joint Collector, Prakasam District is directed to dispose of the appeal purported to have been filed by the petitioner assailing the proceedings dated 24-10-2006 of the Revenue Divisional Officer, Ongole, Prakasam District, within a period of two months from the date of receipt of a copy of this order and communicate the same to the petitioner.

The writ petition is accordingly disposed of at the stage of

admission. There shall be no order as to costs.
