ORAL ORDER:

This writ petition is filed seeking a Mandamus declaring the proceedings No.C/3648/2006 dated 24.10.2006 issued by the first respondent and also the action of the third respondent in not passing any orders on the appeal filed by the petitioner against the order dated 24.10.2006 as arbitrary and illegal.

It appears, petitioner is the fair price shop dealer of Dhoolapally village, Qutubullapur mandal, Ranga Reddy district. While so, his authorization was cancelled on the ground that he has been elected as Chairman of Primary Agricultural Cooperative Society, Dhoolapally in the year 2005, therefore, he acquired disqualification for being continued as fair price shop dealer. Aggrieved by the same, the present writ petition is filed.

Since the petitioner has already availed statutory remedy of appeal before the third respondent-Joint Collector and the same is pending, the third respondent is directed to dispose of the appeal filed by the petitioner against the orders passed by the first respondent dated 24.10.2006, within a period of six weeks from the date of receipt of a copy of this order. However, during the pendency of the appeal, the impugned proceedings dated 24.10.2006 shall not be given effect to.

The writ petition is accordingly disposed of. No order as to costs.
