This writ petition is filed seeking a Mandamus to declare action of the 3^rd respondent in not finalizing the proceedings in Case No.27/01/57 filed against the petitioner in the year 2001 even after lapse of five years and not considering the representation dated 4.10.2006 for restoration of the hawker licence as arbitrary and illegal.

It appears that the petitioner held kerosene hawker licence of Shalapadu Village, Chebrolu Mandal, Guntur District. While so, by an order dated 2.3.2001, his licence was suspended and the 4^th respondent, who is the regular fair price shop dealer of the same village was put in-charge for distribution of kerosene to the card holders. According to the petitioner, no further enquiry has been conducted after suspension of licence on 2.3.2001 and no cancellation orders were passed even after lapse of 5 years. Therefore, the petitioner made several representations, but there

was no response. On 4.10-2006, he made fresh representation to the 1^st respondent requesting him to restore the licence on humanitarian grounds on par with the licences that were restored while the final proceedings are pending. But the same has not yet been considered.

In view of the above, without expressing any opinion on merits, the 1^st respondent is directed to consider the representation purported to have been filed by the petitioner on 4.10.2006 and pass appropriate orders after hearing him, within a period of six weeks, from the date of receipt of a copy of this order and communicate the same to the petitioner.

Writ petition is disposed of accordingly. No costs.
