Heard the learned counsel for the petitioner and the learned counsel for the respondents.

The petitioner claims to be a retail kerosene dealer. It is stated that he was appointed as a retail dealer in the year 1993 and since then he has been distributing kerosene to the cardholders. This writ petition is filed seeking a direction to the respondents 2 and 3 to consider his case for conversion as fair price shop dealer in pursuance of the Circular dated 19-03-2005 issued by the first respondentCommissioner of Civil Supplies. The petitioner states that a representation dated 12-09-2005 was submitted to the second respondent requesting to consider his case as well as the other similarly situated dealers for conversion as fair price shop dealers and for allotting existing vacant shops. However the respondents failed to consider the same and no orders have been passed so far.

When the matter is taken up for consideration, it is brought to my notice by the learned counsel for the petitioner that W.P.No.3015 of 2006 filed by the some of the retail kerosene dealers with an identical prayer was disposed of by this Court, by order dated 03-03-2006, with the following directions:

“ In the circumstances stated by the petitioners, the respondents are directed to consider the cases of the petitioners for conversion as fair price shop dealers in accordance with the existing policy of the State

Government, including in any existing or arising vacancies of fair price shops. If the State policy obligates consideration of the cases of the petitioners for conversion as fair price shop dealers, the respondents shall consider the cases of the petitioners in terms of the existing policy of the State, expeditiously. The writ petition is disposed of, as above. There shall be no order as to costs.”

Having regard to the facts and circumstances of the case, particularly keeping in view that the petitioner also stands on the same footing, following the decision of this Court in W.P.No.3015 of 2006, dated 03-03-2006, this writ petition is disposed of with a direction to the respondents to consider the case of the petitioner for conversion as fair price shop dealer in accordance with the existing policy of the State Government. If the State policy obligates consideration of the case of the petitioner for conversion as fair price shop dealer, the respondents shall consider the case of the petitioner in terms of the existing policy of the State expeditiously. No costs.
