Sri N. Narasimhulu, Vs The District Collector

The petitioner was a fair price shop dealer of Indluru village, Penagalur Mandal, Kadapa District. After a show-cause notice issued alleging violation of the terms of the authorization in the running of fair price shop to which the petitioner submitted an explanation. The 3^rd respondent by a proceedings dated 18-12-2005 cancelled the authorization of the petitioner. Aggrieved the petitioner preferred an appeal to the 2^nd respondent. By an order dated 20-07-2005 the 2^nd respondent rejected the appeal confirming the proceedings of the 3^rd respondent. The petitioner thereupon filed a review to the 1^st respondent. Along with the review he preferred an application seeking stay of the appellate order dated 20-07-2005. By the order impugned dated 17-12-2005 the 1^st respondent rejected the petitioner’s application for interim stay though without recording any reasons. It is this order, which is subject matter of the writ petition.

In the circumstances, this Court is not inclined to interfere with what is merely an interim order of the 1^st respondent-revisional authority declining stay of the appellate order of the 2^nd respondent pending revision.

Accordingly the writ petition is disposed of directing the 1^st respondent to expeditiously and in any event within a period of three (3) weeks from the date of receipt of a copy of this Order consider and dispose of the petitioner’s revision duly recording reasons for the decision. The final order of the 1^st respondent-revisional authority shall be communicated to the petitioner within the aforesaid time without fail or demur.
