Heard the learned counsel for the petitioner and Sri P.V.Sanjiv Kumar,

the learned counsel appearing for the respondents.

The learned counsel state that the matter could be disposed of at the stage of admission.

¶14

The petitioner is aggrieved that the respondents are not taking steps to analyse the retained samples of petroleum products relating to the petitioner’s retail outlet and have suspended the sales by the petitioner and that this action is illegal and arbitrary.

At the admission hearing, it is stated by the learned counsel appearing for the respondents that one of the samples drawn from the petitioner’s retail outlet on 23.6.2006 has been received and tested by the Bangalore Laboratory and that the report is also received and a show cause notice has been issued to the petitioner calling upon to explain as to why the dealership be not terminated.

The petitioner undertakes to submit its explanation within 2 (two) Weeks from the date of receipt of a copy of this order.

The learned counsel appearing for the respondents states that on receipt of the explanation, a final decision on further action would be taken by the respondent-Corporation, expeditiously.

In the view of the aforesaid submissions, the petitioner may submit its explanation within a period of 2 (two) Weeks from the date of receipt of a copy of this order. Within 6 (six) Weeks from the date of receipt of the petitioner’s explanation, the 1^st respondent is directed to ensure that final orders are passed in the proceedings initiated against the petitioner for alleged adulteration of the petroleum products in his outlet.

The writ petition is, accordingly, disposed of at the admission stage. No costs.
