C.Komaramma Vs The Government of Andhra Pradesh,. Revenue (Ff.Ii)

The petitioner is wife of one Cheerela Venkataiah, who was sanctioned Freedom Fighters Pension under a State scheme. After death of her husband, the petitioner approached the respondents for grant of family pension. When the same was not considered, she filed W.P. No.8637 of 2006, but she withdrew the same and at the request made by the learned Counsel for the petitioner, the writ petition was dismissed as withdrawn. Again the present writ petition is filed with similar prayer. As the petitioner did not seek leave to file a fresh writ petition, the earlier order passed on 26.4.2006 in W.P.No.8637 of 2006 operates res judicata. However, learned Counsel for the petitioner brought to the notice of this Court the letter addressed by the District Collector, Karimnagar, on 06.12.2005 to the first respondent requesting to sanction family pension to the petitioner. The petitioner, therefore, may pursue the matter with the respondents and no direction can be granted in her favour.

The writ petition is accordingly dismissed. No costs.
