Shaik Moulali, Vs The Commissioner for Cooperation and Registrar of -

This writ petition is directed against the order dated 24.4.2006 passed under Section 61 of the A.P. Cooperative Societies Act (for short ‘the Act’) by the third respondent in Claim No.23/2005-2006.

2. The only grievance of the petitioners is that in the very same arbitration claim the petitioners had complained against the second respondent who is superior officer to the third respondent. Further, though he sought 3 to 4 adjournments, the matter was disposed of ex parte without hearing the petitioners.

3. In view of the above, without going into further details, the impugned order is set aside and the first respondent is directed to take

up the matter by himself or he may refer the matter to any other officer except the third respondent, and the matter shall be disposed of after putting the petitioners and all other concerned parties on notice and hearing them within a period of three weeks from today.

4. With the above direction the writ petition is disposed of. The interim order granted on 18.7.2006 stands dissolved. No costs.
