This is a taken up Writ Petition basing on the Telegram dated 14.09.2005 sent by the petitioner complaining that the Station House Officer, Town Police Station, Warangal along with one Aravind Vyas of Kiran Industries, Karimnagar wrongfully

confined him and took six post dated cheques in favour of the National Export Industries and another and also an agreement and seeking a direction to respondents 2 to 4 to enquire into the matter and to take necessary action.

Learned Government Pleader for Home took notice on behalf of the respondents and filed counter-affidavit of the Deputy Superintendent of Police, Warangal Town, Warangal.

It is stated in the counter-affidavit that the petitioner was never forced to give any cheques in favour of the National Export Industries at Gujarat at the instance of M/s. Kiran Industries represented by Mr.Aravind Vyas by any of the Police Personnel belonging to the Town Police Station, Warangal and the allegations in this regard are not true and the same are denied.

It is further stated that on enquiry, it revealed that some financial transactions took place between the petitioner and the National Export Industries at Gujarat and also Srivastava HI-Tech Pro-Oil Complex Private Limited and that the petitioner is due some amounts to the above said two Industries and Mr.Aravind Vyas of M/s.Kiran Industries acted as an agent in the business transaction between the petitioner and the above named two Industries and that the petitioner voluntarily entered into a Memorandum of Understanding and gave cheques in favour of M/s. National Export Industries and Srivastava HI-Tech Pro-Oil Complex Private Limited in the presence of Mr.Aravind Vyas of M/s.Kiran Industries. It is stated that the Police are nothing to do with the financial transactions between the petitioner and the above said two Industries. It is further stated that on enquiry, it revealed that the petitioner gave notice to the above said two Industries through an Advocate to which a reply dated 19.09.2005 was sent by them through their Advocate.

In view of the categorical statements made in the counter-affidavit, the Writ Petition needs no interference and accordingly it is dismissed.
