JUDGMENT: (Per Hon’ble Sri Bilal Nazki, the Acting Chief Justice)
Learned single Judge vacated the interim order granted earlier. The writ petitioners were successful bidders in respect of certain lands. Bids were called for the grant of lease for a period of three years, but when the matter was placed before the Commissioner, Endowments Department, Hyderabad, he gave approval for the lease of one year only. Learned single Judge noted that as per Rule 16 of A.P. Charitable and Hindu Religious Institutions and Endowments Lease of Agricultural Land
Rules, 2003, unless the lease is confirmed by the competent authority, there would not be any lease, which can be enforced. In this view of the matter, he vacated the interim order. We do not find any ground to interfere in the order of learned single Judge.
The writ appeal is accordingly dismissed. However, it is directed that if there is any standing crop raised by the writ petitioners, they may be allowed to harvest the crop provided that is done within a week from today.
