JUDGMENT: (Per Hon’ble Sri Bilal Nazki, the Acting Chief Justice)
Although the writ petitioner had quoted the rates of Rs.2-20 paise per quintal for transporting of foodgrains for a distance upto 8 kilometres and Re.0-10 paise per quintal for destinations beyond 8 kilometres, the contract work was allotted to the writ appellant, who had quoted the rate of Rs.3-58 paise per quintal upto 8 kilometres and Re.0-14 paise per quintal beyond
8 kilometres. In these circumstances, learned single Judge while entertaining the
writ petition suspended the operation of the impugned order by which the work had been allotted to the writ appellant. We do not find any ground to interfere in the order passed by the learned single Judge.
The writ appeal is accordingly dismissed. However, it will be open for the official respondents to engage the services of the writ appellant also on the rates at which the work is allotted to others, if they so require, without compromising on the rights of the writ petitioner.
