Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a writ of Mandamus or any other appropriate writ or writs, order or direction, declaring and setting aside the order, dated 23.04.2001 issued in G.O.Rt.No.96 on the file of the 1st respondent as illegal, arbitrary and without jurisdiction.

O R D E R:
The petitioner questions the order passed by the 1st respondent-Principal Secretary to Government, Department of Housing, dated 23.04.2001 issued in G.O.Rt.No.96, dated 23.04.2001.
By his order, dated 23.04.2001, the 1st respondent placed the petitioner under suspension, until the conclusion of the disciplinary proceedings relating to the criminal and civil charges. As no action is taken by the respondent authorities till now, this writ petition is filed.
The learned counsel for the petitioner submits that he filed a comprehensive writ petition in W.P.No.18810 of 2003 questioning the said suspension orders issued by the 1st respondent in G.O.Ms.No.96, dated 23.04.2001 as contrary to G.O.Ms.No.86 (Gen.Administration, Services-C) Department, dated 08.03.1994. Hence, he seeks permission of this Court to withdraw the writ petition with a liberty to prosecute the subsequent writ petition.
Recording the submission, the writ petition is dismissed as withdrawn, giving liberty to the petitioner to prosecute the subsequent writ petition filed by him in W.P.No.18810 of 2003. No costs.
