Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not calling the petitioner for interview and test schedule to be held on 13.07.2001 or on any other subsequent date for the post of Operator in Silk Realing Unit in Sericulture Department and to appoint the petitioner to that or any other post for which the petitioner was found suitable in Sericulture Department in spite of question of all qualification for the said post is arbitrary, illegal, unjust and the petitioner is opposed to the comes of law

The writ petition is filed to declare the action of the respondents in not calling the petitioner for interview and test scheduled to be conducted on 13.07.2001 to the post of operator in Silk Realing Unit in Sericulture Department and to appoint him to the said post if he is found suitable and qualified.

This Court by order dated 10.07.2001 granted interim direction directing the respondents to interview the petitioner for the post of Operator or to any other post to be held on 13.07.2001. The said interim order was passed following the judgment of the Apex Court in K.B.N. VISWESWARA RAO v. EXCISE SUPERINTENDENT MALAKAPATNAN &

OTHERS. In view of the above interim order no further orders are necessary.

Accordingly, the writ petition is disposed in terms of the said interim order. No costs.
