This suspension of sentence application has been filed by the accused-applicant along with the appeal.

Accused-applicant has been convicted and sentenced to undergo life imprisonment for the offence punishable under Section 302 IPC.

Counsel for the accused-applicant submits that the applicantaccused has taken NOC from him.

Learned Deputy Government Advocate assisted by counsel for the complainant opposed the application for suspension of sentence.

We have heard counsel for the parties and perused the record.

This suspension of sentence application is pending since 04.01.2025 and according to the order-sheets, adjournment was sought on each and every date to argue the matter, and today also, when the matter was taken up, counsel for the applicantaccused submits that the applicant-accused has taken NOC from them.

Considering the facts and circumstances of the present case, and also considering the statement of PW5—eye witness, the applicant-accused has caused knife injury on the person of the deceased as well as considering the FSL Report—Ex.P27 which has also been found positive, no case is made out to allow this application for suspension of sentence.

In that view of the matter, this application for suspension of sentence stands dismissed.
