This writ petition has been filed by the petitioner challenging the order dated 13.12.2021 passed by Central Administrative Tribunal, Jaipur Bench, Jaipur, (hereinafter referred as ‘Tribunal’), whereby an original application No.647/2017 filed by the petitioner was dismissed.

The brief facts of the case are that the respondents conducted a selection process for promotion to the post of Assistant Train Controller. A panel of six candidates was prepared

by the respondents vide order dated 13.06.2011, wherein the name of the petitioner appeared at Serial No. 6. The grievance raised by the petitioner before the Tribunal was that one selected candidate refused to accept the promotion and, therefore, the petitioner claimed a right to be considered for promotion to the said post. Admittedly, the petitioner was placed at Serial No. 6 in the selection panel, whereas only four posts were advertised by the respondents.

The matter of promotion pertains to the year 2011 and after the lapse of 15 years, we are not inclined to disturb the settled position in the department with regard to seniority and promotion of the employees.

In that view of the matter, no case is made out for interference by this Court in the order passed by the Tribunal. 5. The writ petition is dismissed.
