Learned counsel for the petitioner submits that petitioner was placed under suspension vide order dated 25.02.2025 (Annx2) from the date of his arrest i.e. 22.10.2024. Counsel submits that the petitioner was suspended on false allegations and the allegations are not sufficient to warrant suspension in contemplation of enquiry. Counsel submits that placing a public servant under suspension for a longer duration is also against the public policy. Counsel places reliance upon judgment of Hon’ble Supreme Court rendered in case of Ajay Kumar Choudhary versus Union of India & Anr. reported in AIR 2015 SC 2389 and submits that petitioner is entitled to reinstatement pending inquiry.

Heard learned counsel for petitioner and perused the material available on record as well as the judgment as referred by learned counsel for petitioner.

Considering the grievance raised herein, the petitioner is given a liberty to raise his grievances before the respondentsAuthority by way of representation, within a period of 30 days from the date of receipt of certified copy of this order. The respondents-Authority are directed to consider and decide the petitioner’s representation, if any filed, after considering his grievances, in the light of ratio laid down by the Hon’ble Supreme Court in case of Ajay Kumar (supra), but in case of deviation, with a reasoned and speaking order within a period of 30 days from the date of receipt of representation. After the decision, the respondents are under an obligation to communicate the decision to the petitioner either by way of speed post or through E-mail, if petitioner has provided E-mail address in his representation.

In the event, the petitioner is not satisfied with the decision of the respondents-Authority on his representation, he would be at liberty to approach this Court with fresh petition.

Accordingly, this Civil Writ Petition is disposed of.

Stay application and pending application(s), if any, also stand disposed of.
