The present is second round of litigation.

Learned counsel submits that vide order dated 16.02.2026, categorical directions were passed by the Coordinate Bench of this Court to decide the appeal, “preferably” within a period of 10

days. It is submitted that in compliance of the said directions, the petitioner preferred the said appeal/ submitted a representation, in the month of January, 2026. It is further submitted that petitioner has also marked his presence before the competent authority on the tenth day, but no opportunity of personal hearing was accorded to him by the respondents. Thus, it can be noted that despite judicial categorical directions qua deciding the appeal with a suffix being used as “preferably” within a period of 10 days, a cursory or ignorant approach ought not to be taken by the respondents; as the plea of the petitioner is yet not considered.

Per contra , learned counsel for the respondents vehemently opposed the present petition and refuted the aforesaid submissions.

Having heard the submissions advanced and without commenting upon merits/demerits of the case, this Court directs the petitioner to mark his presence before the Appellate Authority on 14.05.2026 at 11.00 AM. The Appellate Authority is also directed to afford due opportunity of personal hearing to the petitioner and pass a reasoned and speaking order within a period of seven days thereafter, strictly in accordance with law.

Accordingly, the present petition stands disposed of. Pending application(s), if any, shall also stand disposed.
