The present with petition has been filed assailing the order dated 21.02.2026, passed by learned Gram Nayalaya, Nawalgarh, District-Jhunjhunu, in Civil Suit No. 14/2022, whereby the application filed by the petitioner under Order 18 Rule 18 CPC has been rejected.

Learned counsel for the petitioner contends that the civil dispute could be effectively resolved if an inspection is carried out by the Court itself.

Learned counsel for the petitioner further submits that an application to this effect was filed before the learned Gram Nyayalaya; however, the same has been dismissed.

This Court finds that inspection by the Court is a matter within its sole discretion and cannot be undertaken at the instance of any party. Therefore, this Court finds no error in the impugned order so as to warrant interference under its writ jurisdiction. However, the learned Gram Nyayalaya is at liberty, at any stage of the proceedings, whether during hearing or at the time of adjudication, to conduct an inspection if it deems it necessary.

With the above observations, the present writ petition stands disposed of.
