These writ petitions have been filed by the petitioners with the following prayer:-

“(i) In these circumstances, it is, therefore, prayed that this Hon’ble Court may be pleased to accept this Writ Petition and the impugned Amendment Rules of 2013 dated 08.07.2013 and the impugned condition note 5 of the advertisement dated 11.03.2022 whereby the Humble Petitioners despite having the work experience as a Livestock Assistant has not been considered eligible for grant of bonus marks, may kindly be declared illegal and arbitrary and therefore, same may kindly be quashed and set aside as the same is unconstitutional and ultra vires;

(ia) In these circumstances, it is, therefore prayed that this Hon’ble Court may be pleased to accept this Writ Petition and the impugned final result dated 07.09.2022 whereby the Humble Petitioner despite having the work experience as a Livestock Assistant have still not been considered for the grant of bonus marks may kindly be declared illegal and arbitrary, and, therefore, the same may kindly be quashed and set aside.

(ii) By issuing the writ of mandamus, order or

direction in the nature thereof the Respondents may kindly be directed to:-

a) to issue the work experience certificate of the Humble petitioners:

b) to provide the benefits of bonus marks to the the Humble Petitioners for the experience as gained as Departmental Contractual Employees

c) to declare Humble Petitioners are qualified for the further process of recruitment on the post of Live Stock Assistant after adding of the bonus marks as per the prior working experience so gained;

¶104

d) to give appointment to the Humble Petitioners on the post of Livestock Assistant with all consequential benefits.

(iii) Any other appropriate order or direction which this Hon’ble Court deems just and proper in the facts and circumstances of this case may kindly also be passed in favour of the Humble Petitioners.”

Learned counsel for the respondents submits that the issues involved in the present matter have already been considered and decided by a Co-ordinate Bench of this Court in ‘ Paramweer

¶107

Singh & Ors. vs. State of Rajasthan & Ors. ’ passed in D.B. Civil Writ Petition No.6580/2019 decided on 05.08.2020.

We have gone through the prayer made by the petitioners. The petitioners have challenged the amendment made in the ‘Rajasthan Animal Husbandry Subordinate Service (Amendment) Rules 2013 (hereinafter to be referred as ‘Amended Rules of 2013’). Since the validity of the said Rules has already been considered by a Division Bench of this Court in ‘Paramweer Singh (supra)’.

Learned counsel for the petitioners submits that there is a differentiation between the facts of the present case and the judgment in Paramveer Singh ( supra ). However, we are not inclined to re-examine the issue regarding the validity of the Rule,

as the same has already been upheld by a Co-ordinate Bench of this Court.
