This writ petition has been filed by the petitioner with the following prayers:-

“It is, therefore, humbly and respectfully prayed that the Writ Petition filed by the petitioner may kindly be pleased to accept and allow and

(1) by issuance of suitable writ, direction

or order in the nature thereof the thereby Hon'ble Court may kindly be pleased to expunge the illegal and ultra virus term (b) with regard to at least three years teaching experience as Senior Resident or Tutor or Demonstrator or Registrar or Assistant Professor or Lecturer in the concerned Specialty or Super-Specialty in a recognized teaching institution after obtaining the post graduate degree in recruitment of the Teaching faculty (Assistant Professors in EXIC PGIMSRS and ESIC Medical Colleges on Direct Recruitment Basis in pursuance advertisement dated to for the 16.06.2022 for the recruitment on the post the Assistant

Professor issued by the Deputy Director, Employees State Insurance Corporation, (Ministry of Labour & Employment, Government of India), New Delhi.

ii) by issuance of suitable writ, direction or order in the Court nature may thereof be thereby the Hon'ble court may kindly be pleased to declaring ultra virus and illegal to the term and condition of the sub Section 7 (B) of Point No. 8 of the Schedule with regard to eligibility for the post of the Assistant Professor as prescribed in the Gazette of India Notification No. CG-DL-W-04062022236286 Serial No. 23 dated 0410.06.2022.

iii) by issuance of suitable writ, direction or order in the nature thereof thereby the Hon'ble Court may kindly be pleased to direct the respondent No. 3 to appoint the petitioner on the post of Assistant Professor

(Psychiatry) and in the alternative the respondents be directed to kept one post of the Assistant Professor (Psychiatry) for the petitioner.

(iv) Any other order or direction, which your Lordships may deem just and proper in the facts and circumstances of the case, may kindly be passed in favour of the petitioner and in the interest of justice.

process relates to the year 2022 and subsequently new notification has also been issued in the year 2024.

We have perused the record.

¶34

There is no interim order passed by this Court.

¶35

In that view of the matter, in our considered view, by efflux of time, the present writ petition has become infructuous and the same is dismissed accordingly. However, the petitioner is at liberty to file fresh writ petition challenging the new recruitment process if he so desires.
