With the consent of both the parties, the present Civil Writ Petition stands disposed of with the following terms:

(i) The order dated 08.02.2020 to the extent of objection regarding the insufficiency of stamp duty on the agreement dated 08.02.2020 is hereby quashed

and set aside. The learned Trial Court is directed to impound the document dated 27.09.1990 and send it to the competent authority for the purpose of valuation and payment of the requisite stamp duty.

(ii) The learned Trial Court shall thereafter permit the said document to be admitted in evidence only in accordance with the provisions of the Stamp Act. However, any objection regarding the registration of the document is kept open and shall be decided by the learned Trial Court at the appropriate stage. (iii) It is further submitted by both the parties that, with regard to the photographs, the certificate under Section 65B has been filed. Therefore, no further orders are required in respect of those photographs, as they have already been permitted to be read in evidence. With respect to the document which is photocopy on which the objection was raised, both parties agree that if anything contrary to the document obtained by the respondent under RTI placed on record, the petitioner shall be at liberty to file documents in rebuttal of the same.
