This writ petition has been filed by and on behalf of the defendants, feeling aggrieved by dismissal of their application under Order VII Rule 10 CPC, through which objection was raised before the Commercial Court that the commercial suit is triable before the Court at Gujarat/ Haryana and not before Alwar.

Counsel for the respondent-plaintiff, at the outset, pointed out that after passing the impugned order, the commercial suit itself has been decreed vide judgment dated 28.04.2026. A copy of the judgment and decree dated 28.04.2026 has been placed on record.

Counsel for petitioners, in such view of the matter, seeks permission to withdraw this writ petition with liberty to raise the objection of territorial jurisdiction in the appeal, if filed against the judgment and decree dated 28.04.2026.

In view of the above, without expressing any opinion on the merits/ demerits of the impugned order, instant writ petition is allowed to be withdrawn and the same stands disposed of accordingly with the liberty as prayed for.
