The present petition has been filed seeking directions to allow the petitioner to join the post of Junior Specialist (General Surgery) in the Department of Medical and Health Services, Government of Rajasthan.

Learned counsel for the petitioner has submitted that the petitioner was initially appointed to the post of Junior Specialist (General Surgery) vide order dated 16.06.2012 on probation for two years. It is submitted that the petitioner has filed a representation to the respondents on 25.12.2025 with a prayer that effect be given to his joining as per his lien. It is further submitted that the respondents have not taken any decision on

the said representation, neither have relieved the petitioner, moreover, have not passed any order allowing the petitioner to join back on the post of Junior Specialist (General Surgery). It is also submitted that by 10.01.2026, the petitioner will be confirmed on the post of Assistant Professor, which will cause prejudice to the instant case.

Qua respondent nos.1 and 4, Mr. Archit Bohra, AGC, has marked his presence and is not able to refute the above contentions.

Considering the facts and circumstances of the case, this Court deems it proper to dispose of the present petition with direction that on 09.01.2026 at 11:00 am, the petitioner shall mark his attendance before respondent No. 1 and his representation upon granting due audience shall be considered by respondent No. 1. further, it is directed that appropriate order shall be passed by the respondent concerned, strictly in accordance with law. The petitioner will be at liberty to raise his submissions on facts as well as on other grounds before respondent No. 1 on the date of audience. It is made clear that no prejudice shall be caused to the parties on account of passing of this order.

Accordingly, the present petition is disposed of. Pending applications, if any, also stand disposed.

The instant order has been passed with an expectation that the appropriate order shall be passed by respondent no.1 prior to 10.01.2026.
