Supreme Court in the case of M. Paul Anthony Vs. Bharat Gold Mines Ltd. & Anr. reported in (1999) 3 SCC 679 as well as Eastern Coalfields Limited & Ors. Vs. Rabindra Kumar Bharti reported in (2022) 12 SCC 390 , the petitioner has submitted that Hon’ble Supreme Court has clearly restrained holding of criminal trial and departmental enquiry on identical charges, therefore, under the circumstances, charge-sheet dated 07.11.2025 may either be quashed, or the proceedings may be deferred at least till conclusion of the trial.

is a misconduct under Rajasthan Civil Services (Conduct) Rules, 1971. Thus, it is apparent that even for the purpose of justifying charge No.5, the petitioner is not required to place any evidence so as to defend himself for justifying that he has not committed the offence alleged in the FIR.
