Learned counsel for the petitioner submits that despite the fact that the petitioner secured appropriate position in the merit in Rajasthan Police Constable Recruitment, 2025, yet he has been disqualified during physical measurement test, where his height has been shown as 166.3 cm, whereas in fact it is 168 cm, which is the minimum requirement as per the Rules. Learned counsel submits that after declaring the petitioner ineligible on

02.12.2025, he has secured one health certificate issued by Medical Officer In-charge, Community Health Centre, Jamdoli, Jaipur-I, where his height has been shown as 168 cm.

Learned counsel submits that in the light of variance between the height measured by two different Authorities, he may be granted liberty to get his height measured by the medical experts of AIIMS, Jodhpur and on the basis of such result of remedical examination by the experts of AIIMS, Jodhpur, the Competent Authority may be directed to take further actions.

Although, in the matters of disputed question of facts, such as variance in height of incumbent, this Court generally does not accept the writ petition, however, only in the light of the fact that after 9 days from the date of declaring the petitioner as ineligible on account of height, another Medical Officer has certified that the petitioner is securing the prescribed height, this Court grants liberty to the petitioner to get himself examined for the purpose of ascertaining his height by the experts of AIIMS, Jodhpur. In case, the petitioner submits an application within a period of 7 days along with the demand draft of Rs.10,000/- in favour of Superintendent of AIIMS, Jodhpur then Superintendent of AIIMS, Jodhpur shall constitute a Medical Board for examining height of the petitioner within a period of 7 days thereafter. In case, the medical experts of AIIMS, Jodhpur certifies that the petitioner is possessing height of 168 cm or more, then on the basis of such report, the petitioner shall make a representation before the respondents, who shall consider and decide the same strictly in accordance with law.
