The instant writ petition is preferred by the petitioner with

following prayer:-

“It is, therefore, most respectfully prayed a) to issue an appropriate writ, order or direction to the respondents to consider the Petitioner for appointment on the post of Professor Pharmacology at Medical College Pali.

b) to issue an appropriate writ, order or direction to the respondents to quash and set aside the impugned order dated 14.06.2019 (Annnx-7) c) Issue an appropriate writ, direction or order directing the respondents to consider the application of the petitioner for extension till the

anomaly in the appointment order has been removed.

d) That the Hon’ble High Court may kindly direct the Respondents to consider the candidature of the petitioner on the post of Professor Pharmacology at Medical College Pali

e) Any other writ, order or direction, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case.

It is further prayed that during the pendency of the present petition, petitioner’s seat should not be filled by any other candidate and the same be kept vacant till the disposal of the writ petition.”

Learned counsel for the petitioner while placing reliance upon order dated 16.04.2015 in D.B. Civil Special Appeal (Writ) No.453/2006 : Narain Swarup Sharma Vs. The State of

Rajasthan & Anr. , submits that the writ petition is liable to be allowed in light of the judgment passed by this Hon’ble Court. He further referred the orders passed in respect of petitioner during pendency of the writ petition wherein the services of the petitioner were regularized and now after circular issued by the respondent, the petitioner has prayed that the services rendered by the petitioner in RajMES and Jhalawar Medical College Society be considered in counting the services of the petitioner.

Learned counsel appearing on behalf of the respondents submits that pursuant to order passed by this Hon’ble Court, the petitioner was given appointment on probation and after the probation period, the services of petitioner were confirmed but the only issue left is counting of service, which the petitioner has rendered in Jhalawar and RajMES College, and the petitioner may file a representation to the respondents, and same shall be considered in light of policy of the State.

Having considered the submissions and also the material placed on record and also as referred during course of arguments, the interim orders passed in favour of the petitioner are hereby made absolute and the petitioner is entitled for continuation of service in terms of the appointment order issued by the respondents during the pendency of the writ petition. The petitioner is also entitled for all service benefits available to similarly placed employees. To count past service, rendered by the petitioner in Jhalawar Medical College and Government Medical College, (RajMES) (under the control and authority of the Government), the petitioner is entitled to submit a representation to the respondents, who shall consider and examine the representation in light of the policy/circular/guidelines and the rules and if counting of such service is permissible, the respondents shall consider and pass appropriate order to count said service, rendered by the petitioner in the Institutions mentioned hereinabove. In case of any deviation, a reasoned and speaking order be passed within a period of 60 days from the date of receipt of the representation of the petitioner.

Needless to say that a copy of the order passed by the respondents be supplied to the petitioner who shall be entitled to re-approach the Court by filing a fresh petition. 6. With the aforesaid, the writ petition stands disposed of with pending application, if any.
