This writ petition is filed for quashing the order dated 03.02.2026 passed by the respondent No.2 whereby, the petitioners have been denied benefit of 40 days’ regular parole.

Indisputably, the Hon’ble Supreme Court of India granted the benefit of first parole for a period of 21 days to the petitioner No.1 in Criminal Appeal No. 340 of 2019 vide order dated 22.02.2019, the petitioner No.2 in Writ Petition (Criminal) No. 284 of 2018 vide order dated 15.04.2019 and the petitioner No.3 in Writ Petition(s) (Criminal) No(s).250/2018 vide order dated 26.07.2019. The petitioner Nos. 1 and 2 were extended benefit of second parole by a Co-ordinate Bench of this Court vide order dated 04.02.2021 and the petitioner No.3 was extended this benefit by a Co-ordinate Bench of this Court vide order dated 22.07.2021. Subsequently thereto, the petitioners were extended benefit of third parole for a period of 40 days vide order dated 09.02.2023 by a Co-ordinate

Bench of this Court. Again, the petitioners were extended benefit of fourth parole for a period of 40 days by a Co-ordinate Bench of this Court vide order dated 17.10.2024. There is no allegation against them of misusing the liberty of parole extended on earlier occasions. As per the reply filed by the State, jail conduct of the petitioners is satisfactory.

In view of the aforesaid admitted position, this criminal writ petition is disposed of in following terms as agreed and requested by the learned counsels for the respective parties:-

(1) The order impugned dated 03.02.2026, qua the petitioners, is quashed and set aside.

¶32

(2) The petitioners are extended benefit of 5^th parole for a period of 40 days from the date of their release subject to condition that each of them shall furnish a personal bond of Rs. 1 Lakh and two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of the Superintendent, Central Jail concerned who shall also be at liberty to impose such other just and suitable conditions as prescribed. They shall surrender back in time.
