Petitioners Sanjay Sharma & Nagarmal Kumawat are present in person and they have duly been identified by their respective counsel. The complainant Ramjilal Meena has expired and his son Mahesh Meena is present in person and he has duly been identified by his counsel.

By way of these Criminal Misc. Petitions under Section 528 of BNSS, the accused-petitioners have approached this Court with a prayer to quash FIR No.23/2019 registered at Police Station Jamwa Ramgarh, District Jaipur Rural for offences punishable under Sections 420, 406 and 120B of the IPC and all consequent proceedings arising out thereof on the basis of compromise.

Learned counsels for the petitioners submit that the complainant of this case has expired and the petitioners have settled their dispute amicably with the legal heirs of the deceased/ complainant i.e. his wife, son and one daughter, who is 17 years old. It is submitted that due to compromise, further proceedings in the aforesaid FIR are fruitless and continuation thereof would be a futile exercise and a waste of precious judicial time and

resources. The written compromise has been annexed with these petitions.

In compliance of the directions of this Court, learned State counsel places on record the verification report dated 09.02.2026 received from the Dy. Superintendent, Circle, Police Station Jamwa Ramgarh, District Jaipur Rural. According to the said report, the legal heirs of the deceased and petitioners have entered into compromise.

Under the instructions of the son of the

deceased/complainant, counsel submits that they have no objection if these petitions are allowed and impugned FIR lodged against the petitioners are quashed on the basis of amicable settlement arrived at between the parties.

In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for perusal; considering the fact that parties have resolved their dispute amicably and also finding that the present case is wholly covered by the principle of law laid down by Hon'ble Supreme Court in the case of Gian Singh versus State of Punjab & Anr., reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. versus Choudhary Bhajan Lal & Ors., reported in AIR 1992 SC 604 , the impugned FIR is liable to be quashed in view of compromise arrived at between the parties.

In view of the above, these Criminal Misc. Petitions are allowed and the FIR No.23/2019 registered at Police Station Jamwa Ramgarh, District Jaipur Rural for offences punishable

under Sections 420, 406 and 120B of the IPC along with all consequential proceedings arising out thereof is quashed and set aside. Consequence to follow.

The stay application(s) and pending application(s), if any, also stand disposed of.

As petitioner Mukesh Gurjar has already been arrested in connection with the impugned FIR, he shall be released forthwith, if not required in any other case.
